Afghan Family Sues Germany Over Delayed Visas Despite Admission Under Federal Program
A 14-member Afghan family has filed a lawsuit and an urgent application with the Administrative Court in Berlin against the German government for failing to issue visas, despite having received an official promise of admission under Germany’s Federal Admission Program.
The family, led by an Afghan woman who is a scientist and writer, has been stranded in Pakistan for 16 months, awaiting visas from the German Foreign Office. Due to her work in sensitive fields, she was granted admission through a special program designed for individuals deemed “particularly exposed” or “individually at risk”, including professionals in politics, media, or the judiciary. This status extends to her spouse, children, and close relatives, forming the 14-member group now awaiting relocation.
Visa Application Delayed Since Early 2024
The family submitted their visa applications at the German Embassy in Islamabad in January 2024, as Germany has no diplomatic presence in Afghanistan. After attending security interviews in October 2024, they were informed in March 2025 that their visas were ready. However, no further steps were taken, and instead, they were called for an additional interview, causing confusion and fear of deportation, as their Pakistani visas have expired and are no longer renewable.
Legal Uncertainty and Urgent Appeal
Their legal representative noted that the German Foreign Office has not raised any objections during the entire process, making the continued delay and lack of communication all the more distressing. The family is now urging the court to compel German authorities to issue the visas promptly and allow their safe transfer to Germany.
Wider Implications for Germany’s Federal Admission Program
This case could have broader consequences. According to reports, approximately 2,500 Afghans in Pakistan are currently undergoing the same admission procedure under Germany’s special program. Concerns have intensified following recent indications that the new German government, led by Chancellor Friedrich Merz, may seek to terminate the admission initiative.
If discontinued, hundreds of vulnerable individuals and families—already promised safety—may be left stranded without protection or legal recourse.
