France Introduces New Policies to Regularise Undocumented Foreign Workers
Since 2012, the regularisation of undocumented immigrants in France has been governed by the Valls circular, introduced by then-Minister of the Interior Manuel Valls. This directive allowed undocumented workers to seek legal status, and in 2023 alone, 34,724 people were regularised through this method. However, a new directive is set to replace the Valls circular, with updated measures expected to be announced by the end of February 2025.
The Minister of Labor, Astrid Panosyan-Bouvet, highlighted a key issue with the Valls circular: it required undocumented workers to obtain their employer’s permission before applying for regularisation. The new policy aims to address this challenge while focusing on professions experiencing labor shortages. Panosyan-Bouvet, in collaboration with the Ministry of the Interior, has mapped high-demand professions regionally, noting that engineers and master’s students constitute a significant portion of economic immigration.
Stricter Criteria for Regularisation
Despite introducing new changes, the French government plans to tighten the eligibility criteria for undocumented workers. To qualify for regularisation, applicants must demonstrate at least three years of residence in France and two years of employment in a shortage profession.
In 2023, 11,525 individuals were regularised through work, and this number is expected to rise in 2025 as a result of the new measures. However, alongside these updates, France has intensified its immigration controls.
In July 2024, the government introduced stricter rules for employing undocumented migrants, imposing harsher penalties on companies hiring unauthorised foreign workers. Minister of the Interior Gerald Darmanin also announced tightened conditions for issuing residence permits, emphasizing efforts to combat illegal employment and strengthen immigration oversight.
The updated policies aim to balance addressing labor market needs with enhancing immigration control, potentially benefiting thousands of undocumented workers in France.
